The court of Appeal has struck a blow for tradition in its ruling thaat the late Mr. S. M. Otieno be buried in Nyalgunga, Siaya District ,according to Luo custom, rather than in Upper Matasia ,as his widow had desired. Unless parliament passes a law that spells out the circumstances in which customary or common law applied in a case where there is a clash between traditions or tradition and modernity, the kind of harrowing experience through which Mrs. Wambui Otieno has gone is going to remain the lot of many widows of inter-marriages.
